Top Five Georgia Worker's Compensation Tips

1. Report Any Job Injuries Immediately

If you are injured at work, you should immediately report the injury to your supervisor. You should provide your supervisor as much detail as possible about the work injury and pain you are experiencing. Failure to report a workers' compensation injury in a timely fashion could result in the claim being denied.

2. Request Medical Attention

If you are injured at work, it is important that you be seen by a physician as soon as possible. Even if you feel your symptoms might eventually resolve, it is best to allow a medical professional to examine you to confirm you are not severely injured. If there is any doubt as to whether you need to see a doctor, you probably should.

3. Provide an Accurate History of the Injury to Your Doctor

When you are examined by any physician following a work injury, be sure to give the doctor an accurate history of any and all work injuries. Make sure to tell the doctor when you were injured, where you were injured, and where you are experiencing pain. It is also extremely important to give the doctor any information about past injuries and accidents.

4. The Insurance Company Does Not Have the Final Word

The workers' compensation insurance company might tell you they are denying your claim or denying your right to certain treatment or testing. They do not have the final say in these matters. If the workers' compensation carrier denies all or part of your claim, you have the right to request a hearing in front of a Judge. Ultimately, the Judge will make a determination as to whether the insurance company correctly denied the claim.

5. Contact an Attorney

If you have any questions about whether your insurance company is complying with the Georgia Workers' Compensation Act, you should contact an attorney. Injured workers sometimes believe they should not contact an attorney because it is a disservice to their company. You can rest assured that employers have attorneys to protect their rights. You should have an advocate in your corner as well to ensure that the workers' compensation carrier is complying with the law.
