Georgia Wrongful Death Laws
A wrongful death lawsuit allows the surviving family members to pursue a claim on behalf of their deceased loved one. According to Georgia law, wrongful death claims must be filed within two years from the date of the death.
However, if the death was caused by a crime, the statute of limitations is suspended until the conclusion of the criminal case – up to six years. Once the criminal case is resolved, the two-year time limit will start.
The following individuals are eligible to file a wrongful death lawsuit in Georgia, based on this order:
- Surviving spouse
- If there is no spouse, the surviving child(ren)
- If there are no spouse or children, the deceased person’s parent(s)
- If there are no spouse, children, or parents, the administrator or executor of the deceased person’s estate
If an administrator or executor brings the claim, any damages recovered are meant for the benefit of the deceased person’s next of kin. These damages will be held by the estate.
