Pain and suffering damages for work comp case.

In Georgia, an injured worker cannot recover against his or her employer for pain and suffering. Most injured workers do experience a tremendous amounts of pain and suffering as a result of their work injury but the Georgia Workers' Compensation Act does not allow for recovery for that portion of the claim. However, most insurance companies are still willing to settle workers' compensation claims in order to "buy out" the future medical and income benefits owed to the claimant. Depending on the nature of the claim, work comp settlements can be substantial.
