Right to trial and Georgia Workers' Compensation Claims.

In Georgia, if a dispute arises with respect to a workers’ compensation claim, the parties have the right to request a hearing. These hearings look like trials in most aspects, but the ultimate outcome of the case is decided by a single judge called an Administrative Law Judge (ALJ). The rules of evidence at these hearings are essentially the same as the rules of evidence in State or Superior Court. Following an ALJ hearing, the non-prevailing party has the right to appeal to the Full Board of the State Board of Workers’ Compensation, and then to the Superior Court. Additional appeals may also be heard by the Georgia Court of Appeals and the Georgia Superior Court.
