Medicare does not allow workers' compensation claimants to shift the buren of their medical care onto Medicare. If a workers' compensation claimant is also a Medicare beneficiary or has a reasonable expectation of becming a Medicare beneficiary, then a Medicare Set-Aside (MSA) may be neccessary prior to settlement.
