Medicare and workers' compensation claim.

Medicare does not allow workers' compensation claimants to shift the buren of their medical care onto Medicare. If a workers' compensation claimant is also a Medicare beneficiary or has a reasonable expectation of becming a Medicare beneficiary, then a Medicare Set-Aside (MSA) may be neccessary prior to settlement. MSA's can be complex and an injured worker on Medicare should seek the advice of an attorney before settling their workers' comp case.
