Denial of workers' compensation claim based on subsequent intervening accident.

In Georgia, workers' compensation carries frequently allege that a subsequent intervening accident (as opposed to the job injury) is the cause of an injured worker's disability.  However, if an injured worker is receiving income benefits and is involved in a subsequent accident, the Georgia Workers' Compensation Act and Board Rules do not allow for unilateral suspension of income benefits.  To the contrary, an Employer/Insurer must request a hearing and prove that the injured worker's disability is no longer related to his accident.  If you have any questions about a workers' compensation claim, contact Atlanta workers' comp attorney Brian H.
