Caps on workers' compensation damages in Georgia.

Generally speaking, Georgia is a "no fault" state with regard to workers' compensation claims. If you are injured at work the workers' compensation carrier is supposed to pay for your claim regardless of whether you were at fault. The tradeoff, however, is that there are caps on damages. The workers' compensation carrier does not have to pay for pain and suffering. They do not have to pay for 100% of your lost wages. In fact, the workers' compensation carrier is only required to pay two thirds of your average weekly wage for time missed from work. Of course, they are also required to pay a PPD rating and medical benefits.
