Employers are often less concerned with the well being of an injured worker following a job injury and more concerned about having the injured worker take a drug test. Many people believe that a drug test is warranted or relevant in all workers' compensation claims. This assumption is false. In fact, there are very few cases where a drug test is actually relevant and timely administered. Under Georgia workers' compensation law, a drug or alchohol screening has to be performed within a certain amount of time following a job injury. Further, in order for a drug screen to be relevant, there has to be a causal connection between the alleged intoxication and the job accident.
